Frequently Asked Questions

About Gold Coast Litigation Lawyers resolutions and disputes.

How much does litigation on the Gold Coast cost?

This depends on the complexity and degree of difficulty. Costs to start range from $400 for minor cases to $1,200. Costs to completion will vary depending on the complexity of your issue. To enable you to plan, we give you fixed costs for each stage of the dispute resolution and litigation process.

What should I do if I’m being sued?

We advise you seek legal advice immediately as you have a limited time (usually 28 days) in which you can file your defence documents. In the case of debt recovery, failure to lodge documents within the required time limit could cost you thousands.

What is QCAT and should I use it for my claim?

The Queensland Civil and Administrative Tribunal is designed for those who represent themselves. If the value of your claim is under $25,000, then QCAT might be an alternative to legal representation.

What will it cost me to declare bankruptcy?

The costs depend on whether you are filing as an individual or as a corporation. As a guide, costs range from around $500 for an individual to up to $2,000 for a corporation. We advise that you seek legal advice before you file as we might be able to protect some of your assets and help you with creditors.

Who do I contact if I can’t find a Will?

We recommend that you work with a solicitor who can help you locate a Will if it exists.

What is a breach of contract?

When one party fails to fulfil the terms of a contract, they are considered to have breached the contract. Failures could include not delivering on time, not holding the required insurances or failure to deliver services or items to the required standard.

How can I protect myself against leasing disputes?

Disputes can range from disagreements about rent level or failure to pay rent to where a landlord causes difficulties for the tenant’s ‘quiet enjoyment’ of the premises they’re renting. To mitigate your risk, you should ensure that you’re fully aware of your legal obligations as a tenant or a landlord. For residential, the Tenants Fact Sheet has more detailed information. For commercial leasing, see this leasing guide from the Queensland Law Society.

Can I appeal a Planning and Environment Court decision?

Yes, you can but it’s a better option to try to make sure that any dispute goes in your favour from the outset. It’s wise to get legal advice from a solicitor who is familiar with the requirements of development applications and the need (in some cases) for community consultation.

What is alternative dispute resolution and when should I use it?

Whatever your problem, going to court should be your last resort. Competent solicitors in Queensland will advise you to use alternative dispute resolution. This is a method of helping various parties to settle disputes with the help of a mediator.

If you need fast resolution for your commercial, business or personal civil litigation or dispute claims, we’re here to help.
